Cookly offers its visitors the opportunity to book cooking classes and other culinary activities via the Internet platform www.cookly.me. Suppliers of these services offer these activities on their own behalf and under their own responsibility.
1. General
1.1 Accepting the Terms of Use
By visiting Cookly you accept these Terms of Use of Cookly and Suppliers of Culinary Services when you book services on Cookly. If you do not accept these provisions, please stop using the website and leave it.
1.2 Intended use
All users are open to visit the website according to its intended use. The use of further service such as the reviewing of services requires prior registration.
1.3 Changes to the booking platform
Cookly reserves the right to change the content, structure, functions, and so on, of the internet platform, add new functions, or partially or fully suspend existing content and functions temporarily or permanently, as well as attach selected functions to the fulfillment of certain conditions, at any time without notice. Cookly can partially or completely block access to the website for particular users.
You are always legally bound by the Terms of Use at the time of your visit.

For booking services via the website, the General Terms of Business shall apply.

These Terms of Business are divided into two parts:

II. General Terms of Business of Suppliers of Culinary Services
Cookly provides customers and suppliers of culinary services with this booking platform. The contracts are concluded directly between customers and suppliers of culinary services. Cookly is not a contracting party for booked culinary services.
I. General Terms of Business of Cookly

Introduction
These General Terms of Business control the usage of the Cookly website when you sign-up (register an account) or book a service. Furthermore, the Terms of Use and the Privacy Policy if agreed, of Cookly are applicable for the Cookly website.
Upon visiting, attempt to purchase or purchase a culinary services, you agree to these General Terms of Business. Please also visit our Privacy Policy page.
1. Details and Booking Forms / Registration
1.1 Details form and Booking form
Prior to booking a culinary service on www.cookly.me you have to fill a details form. When you fill the details form, you may enter personal information if you agree on our Privacy Policy and your personal info as far as necessary, be forwarded to the supplier during the course of the booking process. Please see our Privacy Policy page
. Prior to making a booking, you have to enter your payment information to complete the purchase of the culinary services.
1.2 Opening of a User Account
Prior to booking a service on www.cookly.me you may proceed to register an account if you agree with our Privacy Policy
1.3 Eligibility to register and use Cookly
Registration is restricted to actionable persons. For the information about the age to use our service, please visit Privacy Policy in the section “Information About Children”. For the registration of a company or a legal body, the person conducting the registration must have proper authorization to act in the name of the company or legal body, respectively.
1.4 Number of User Accounts
The registration of more than one user account for the same natural or legal person is not allowed. The user account is not transferable.
1.5 Truthful information
You are required to provide accurate information and keep it up to date. Cookly is not liable, if a booked service cannot be carried out or other damages occur, because of outdated information. Please visit our Privacy Policy for information about modifying and erasing Personal Data.
1.6 Communication
If you agree on the Terms of Use and Privacy Policy and book a certain service, all booking and payment processes, cancellation of the booking etc. need to be conducted using the specific forms on the Cookly platform on Contact page or send emails to hello@cookly.me. Otherwise there may be difficulties in the proper completion or termination of the contract. In this case, Cookly is not liable.
1.7 No offers
The published culinary services are non-binding offers.
1.8 Booking process
If you decide to book a specific culinary service, you need to agree with Privacy Policy the make the request through the relevant booking interface on the Cookly website and enter accurate information. The request needs to be dispatched by pressing the button Confirm and Book.
1.9 Obligation concerning the Request
You are bound to your request (offer) for 48 hours and 72 hours if alternative offer is offered. For calculation of time, the time zone of the supplier is authoritative.
1.10 Acceptance of the Supplier
Bookings are automatically accepted and confirmed by the system. The booking draws from a contingent, which is administered by the Supplier. An automated booking takes place, as long as there are places left in the contingent. The Supplier must keep the contingent up-to-date at all times.
The supplier provides the agreed services under his own behalf and on his own account.
1.11 Eligibility Requirements
The supplier may set eligibility requirements for his products. These you will find in the product description. You are self-responsible to fulfill these requirements. The supplier is entitled to disapprove or exclude you from a certain service, in case that you do not fulfill the requirements. In this case, there will be no refund.
1.12 Supplier Communication
The supplier of the culinary service needs to conduct booking confirmations, as well as all other communication via the Cookly platform. Thus, if you agree with the Privacy Policy you should always keep the information in your user account up to date and check the e-mail in the given in the user account for new messages.
1.13 Cancellation of a booking
If you need to cancel a booked service, it is mandatory to use the relevant form on the Cookly website Cancellation Request .
2. Review System
2.1 Review System
Upon completion, you have the opportunity to review the booked service using the Cookly review system if you agree with the Privacy Policy. The Cookly Review System aims to create a meaningful and accurate profile of the performance, reliability and trustworthiness of the supplier. If you agree to get up to date information on promotions and deals from Cookly in future travel destinations and receive our newsletter of the Detail Form.The corresponding information will be sent to you via e-mail after completion of the service.
2.2 True and accurate assessment
You are obliged to make only factual and truthful statements. Inaccurate, irrelevant, insulting comments etc. are to be omitted. Cookly is explicitly reserves the right to delete such reviews without giving further reasons. Cookly also has the right to exclude you from further use of the Cookly Platform and to delete your account. Cookly and affected suppliers reserve the right for further legal action, in particular compensation of damages. 3. Legal relationship with Cookly
3.1 Position of Cookly Cookly provides this booking platform to enable you to get in direct contact with a service supplier of your choice and make a booking. The contract relating to the service booked is solely between you and the supplier of the service. Cookly is not a contractual partner for the booked service. Cookly acts solely as the mediator between you and the supplier of the culinary service.
3.2 Your liablity
If you cause any damage to Cookly, you will be held responsible for it.
3.3 Liability of Cookly
If you make a booking, Cookly is only liable to you in cases of gross misconduct (including gross negligence). Cookly is not liable for slight negligence, auxiliary persons, and the mediated supplier and their auxiliary persons. The liability is limited to the immediate damage, excluding consequential damages, loss of profit etc. The liability for punitive damage compensation is also excluded. Further limitations of liability or liability exclusions in these Terms or applicable legal provisions are reserved.
The liability for computer viruses, spyware programs, and other damages caused by computer programs is excluded.
If you are an unregistered visitor and have not made a booking yet, you are subject to the General Terms of Use and subject to some use of the Privacy Policy.
3.4 Changes of these General Terms of Business
These General Terms of Business may be changed by Cookly at any time without prior notice. For each booking, the currently effective Terms are applicable. The user has no guarantee that future bookings will be completed under the existing conditions.
3.5 Applicable Law
The legal relations with Cookly are exclusively subject to Singapore Law. Singapore, Singapore is agreed as the exclusive venue of jurisdiction.
4.1 Position of Cookly Cookly provides this booking platform to enable you to make a booking with the supplier of your choice. The contract relating to the service booked is solely between you and the supplier of the service. Cookly is not a contractual partner for the booked service. Cookly acts solely as the mediator between you and the supplier of the culinary service.
4.1 General Terms Cookly e-gift cards (“Cook the World gift cards”) are distributed by Cookly.
4.2 Redemption E-gift card codes are sent to the "gifter" to be forwarded to a "receiver." The receiver can use the e-gift card code on Cookly's checkout page to book a cooking class, please read more in the Privacy Policy.
4.3 Returns You may not return or cancel your Cookly e-gift card after it is received. If your booking is declined, the amount will be returned to your e-gift card.
4.4 Limitations You may not use an e-gift card to purchase other e-gift cards. E-gift cards cannot be reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if reloaded, resold, transferred for value, or redeemed for cash. Unused e-gift cards may not be transferred. Cookly e-gift cards cannot be combined with other promotion codes.
4.5 Payment Methods Cookly e-gift cards may be paid for with a valid VISA, MasterCard, Discover, American Express or Diners Club, and your transaction to purchase the e-gift cards will be directly between you and BlueSnap or Paypal.
4.6 Delivery Information and Requirements for E-gift Card Purchasers All orders of e-gift cards are subject to a process that compares purchaser information provided here with information about the purchaser provided by the purchaser's financial institution through whom payment is being processed please visit Privacy Policy for more information. If there is a discrepancy, your e-gift card order may be delayed until it can be corrected. We are not responsible for e-gift cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address of the recipient is correct and contact Customer Support if you suspect the recipient did not receive his/her e-gift card. 4.7 Personalized Messaging: If you wish to add a personal message to an e-gift card, simply type your message in the Message field on the e-gift card preview. Personal messages are limited in length to the space provided on the e-gift card. There is no additional charge to include a personalized message. We don't read every gift message, but if we do find inappropriate, offensive or otherwise objectionable messages, we reserve the right to cancel them.

Introduction
These General Terms of Business apply to the contracts between the users of www.cookly.me and the suppliers of culinary activities etc.
1. Acceptance of Bookings
Bookings are automatically accepted and confirmed by the system. The booking draws from a contingent, which is administered by the Supplier. An automated booking takes place, as long as there are places left in the contingent. The Supplier must keep the contingent up-to-date at all times.
2. Truthful Information
The information provided on the Cookly booking platform must be truthful. The supplier reserves the right to cancel bookings when incorrect information has been provided. In this case, the price paid cannot be refunded.
3. Arrival at venue, and compliance with rules
You are responsible for timely arrival at the meeting point. If you are arriving to the booked activity from abroad, you are personally responsible for the necessary travel documents (passport, etc.), compliance with health regulations, etc.
4. Conditions of Participation
You are personally responsible for compliance with any conditions of participation. The provider reserves the right to exclude participants, who do not meet these conditions, from the activity. In this case, the price paid cannot be refunded.
5. Binding Nature of Inquiry
The contract between you and the supplier is automatically accepted and confirmed by the system when the booking is confirmed. By booking a culinary activity service, you accept the offer which is binding you and the supplier. Once the payment confirmed, you will be notified via e-mail.
The booking draws from a contingent once confirmed, which is administered by the Supplier. An automated booking takes place, as long as there are places left in the contingent. The Supplier must keep the contingent up-to-date at all times.
6. Payment
Your credit card will be charged upon booking. If the provider does not accept your booking, the charged amount will be credited back. If the the booking is under “request’’, the funds required to complete the payment are put on hold on your payment method until the booking is accepted. If the request is declined, the funds will be released from hold and refunded to your payment method. If the requested booking is accepted, the payment will be completed. If the culinary offer is under “instant confirmation’’, the booking and payment will be automatically accepted.
7. Disclaimer on Right of Withdrawal
In case that the applicable law for the contract between you and the supplier grants a right of cancellation in favor of you, you waive that right, to the extent permitted by law.
8. Personal Responsibility for Insurance
Insurance is not included in the price. You are personally responsible for a sufficient insurance coverage. The extent of insurance need depends on the booked activity.
9. Unpaid Services
If you do not pay for the booked service or revoke the payment, your claim to the service benefits will be omitted. This will be regarded as a cancellation and cancellation charges will apply according to section 11.
10. Email communication
All communication between you and the supplier must be made through email or the message feature, please read more in the Privacy Policy. The communication through email is solely intended for information concerning the service and its execution. You must not exchange any personal or non service specific questions using email communication. Email communication does not serve to close contracts or to cancel bookings. Such events unfold no effect with regard to Cookly. In such cases it is mandatory to user the appropriate forms.
11. Cancellation Policy
If you want to cancel your booking for an activity, please send us an email at hello@cookly.me or fill the form Cancellation Request as soon as possible. If not stated otherwise by the supplier in the product description, you are entitled to cancel your booking up to 48 hours before the booked cooking class. Please note that our refund policy is the following: 100% of payment, if the cancellation is made 48 hours or more before the cooking class starting time. If you make your cancellation within 48 hours before the booked class, or if you do not attend the class, you will be obliged to pay the full class price.
12. Extraordinary Cancellation
The supplier can cancel the activity without adherence to the cancellation period if weather conditions, governmental actions, unforeseeable or unavoidable external circumstances endanger or make carrying out the activity impossible or substantially more difficult.
This is done under exclusion of any compensation for damages or other claims under what legal basis whatsoever.
13. Exclusion from Participation
The supplier has the right to refuse admittance or exclude you from an activity if you do not meet the eligibility requirements, or if your participation puts you or others at risk, or otherwise interferes with the proper conduct of the activity. In these cases, the price paid cannot be refunded.
14. Program Changes
The supplier further reserves the right to make minor program changes, if deemed necessary due to unforeseeable or unpreventable circumstances.
15. Other Conditions
Further conditions or alternative rules can be found on the respective product pages.
16. Time Zone
For time and date calculations, the time zone of the supplier shall apply.
17. Liability of the supplier of Culinary services
The supplier of culinary service is liable according to applicable law. The liability is excluded to the extent permitted by applicable law.
18. Changes of these General Terms of Business
These Terms of Business are subject to change without prior notice. The terms that are valid at the time of each booking shall apply. The user has no claim that future bookings be completed under existing conditions.
19. Applicable Law
The legal relationship between users and suppliers of services shall be in each case governed by the applicable law.
